Korean Oil Companies - Procurement Fraud/Bid-Rigging ($363 million)

Constantine Cannon represented a whistleblower in a False Claims Act case alleging several Korean oil and transportation companies engaged in a bid-rigging scheme to artificially inflate the price the US military paid for fuel contracts for its bases in South Korea.  Ultimately, five different entities paid a total of $363 million: In November 2018, SK Energy, GS Caltex, and Hanjin Transportation agreed to pay $246 million to resolve both criminal and civil claims; and in March 2019, Hyundai Oilbank and S-Oil Corporation agreed to pay $127 million to resolve both criminal and civil claims.  The settlements represent the largest False Claims Act antitrust recovery ever.  Our client received a whistleblower award of roughly $37 million.  Read more -- WSJ, Reuters, Stars and Stripes, DOJ, CC.

Unitrans/Anham - Procurement Fraud/Defense ($45 million)

Constantine Cannon represented multiple whistleblowers in a False Claims Act case alleging Unitrans International and Anham FZCO violated the US sanctions regime against Iran in securing military contracts to provide food and transportation to US troops.  In December 2019, Unitrans agreed to pay $45 million to resolve criminal and civil charges relating to the matter.  Our clients received a whistleblower award of 28.5% of the government's civil recovery.  Read more -- Washington Post, DOJ, CC.

Cisco - Procurement Fraud/Cybersecurity ($8.6 million)

Constantine Cannon represented a whistleblower in a False Claims Act case alleging Cisco Systems sold the government noncompliant video surveillance software vulnerable to unauthorized access and manipulation.  In July 2019, the company agreed to pay $8.6 million to settle the matter.  It was the first cybersecurity whistleblower case ever successfully resolved under the False Claims Act.  Our client received a whistleblower award of 20% of the government's recovery.  Read more -- Washington Post, Reuters, AP, CC.

Mid Dakota Clinic - Healthcare Fraud/Kickbacks ($5.45 million)

Constantine Cannon represented a whistleblower in a False Claim Act alleging Mid Dakota Clinic engaged in a kickback scheme with its wholly owned ambulatory surgery center to elicit improper patient referrals.  In November 2019, the medical clinic agreed to pay $4.15 million to settle the matter.  Our client received a whistleblower award of 25% of the government's recovery.  Read more -- AP, Becker's, CC.

Skyline Urology - Healthcare Fraud ($2.1 million)

Constantine Cannon represented a whistleblower in a False Claim Act case alleging Skyline Urology misused a billing code to increase reimbursements from Medicare and private insurers in California.  In February 2019, the company agreed to pay roughly $2.1 million to settle the matter. Sharp HealthCare - Healthcare Fraud/Kickbacks (Undisclosed)

Constantine Cannon represented a whistleblower in a False Claims Act case alleging Sharp HealthCare Center for Research, Sharp’s clinical-trial research arm, paid kickbacks to entice prospective trial sponsors to host clinical trials at Sharp.  In November 2019, the company agreed to pay an undisclosed amount to settle the matter.  Our client received a whistleblower award of an undisclosed portion of the government's recovery.  Read more -- CC.

Takata - Auto Safety ($1 billion)

Constantine Cannon represented two whistleblowers in a submission under the Motor Vehicle Safety Whistleblower Act, alleging serious defects in Takata airbags which exploded and claimed the lives of 22 people and set off a worldwide recall of nearly 100 million airbag inflators.  In January 2017, Takata pled guilty to wire fraud and agreed to pay $1 billion in criminal penalties stemming from the company’s fraudulent conduct in relation to sales of defective airbag inflators.  The whistleblower awards our clients received in March 2018 were the first ever made under the Auto Safety Whistleblower Program.  Read more -- NPR, WSJ, Reuters, CC.

Pure Collection - Customs Fraud ($908,100)

Constantine Cannon represented a whistleblower in a False Claims Act case alleging Pure Collection avoided paying U.S. customs duties on its goods shipped from the United Kingdom. Freedom Health/Optimum - Healthcare Fraud/Medicare Advantage ($32.5 million)

Constantine Cannon represented a whistleblower in a False Claims Act case alleging Freedom Health and Optimum Healthcare inflated their Medicare Advantage patient risk scores to secure artificially high Medicare reimbursement.  In May 2017, the companies agreed to pay $32.5 million to settle the matter.  Our client received a whistleblower award of roughly $6.4 million.  Read more -- NPR, Miami Herald, DOJ, CC.
