Wyatt Fore has co-authored a white paper titled "Competition Enforcement, Private Actions and the Shipping Act"

This white paper by Wyatt Fore of Constantine Cannon, together with Kathleen Bradish of AAI, introduces readers to the specialized area of private antitrust enforcement under the Shipping Act.  The authors draw attention to the serious competition issues facing the ocean shipping sector and discuss how private enforcers can use the competition provisions of the Shipping Act to help address some of those problems.  The authors take a critical look at the current enforcement framework and offer proposals about actions Congress and the Federal Maritime Commission can take to promote competition in ocean shipping by making private actions under the Shipping Act more common and more effective.
