Retailers receive $1.1 billion in payments from landmark debit card lawsuit settlement
On December 8, 2009, Constantine Cannon announced the payment of approximately $1.1 billion to U.S. retailers as part of the final large scale distribution of settlements funds in the 2003 class action lawsuit against Visa and MasterCard over their signature debit cards. These disbursements, which accelerated payments that were originally to be made through 2012, will bring relief to retailers during a difficult holiday season. The checks were sent to over 630,000 merchants, the vast majority of which are small businesses. The checks were also sent to cash-strapped charities, schools and state governments.
Given the size of the distribution and its importance to retailers, the payments made big news around the world. The firm’s successful effort to negotiate an accelerated payment schedule and distribute the funds was noted in media outlets that include a television segment on CNBC (click here)

Constantine Cannon LLP assists the American Trucking Associations (“ATA”) to obtain a favorable ruling in the Ninth Circuit regarding ATA’s attempt to enjoin the implementation of a comprehensive regulatory scheme by the Port of Los Angeles and Port of Long Beach that would impact motor carriers’ prices, routes, and services at the largest port facility for containerized cargo in the United States. In reversing and remanding the district court’s denial of a motion for a preliminary injunction, the Ninth Circuit held that the lower court legally erred and abused its discretion.
